José Enrique Abuín Gey, better known as The gum, he sits back in a dock to answer for the alleged violation to his sister-in-law in January 2005, when she was 17 years old and therefore a minor.
The court of instruction number two of Noia has decreed the prosecution of El Chicle, sentenced to permanent prison reviewable by the murder of Diana Quer. In her order, the magistrate indicates that, from the investigation procedures carried out, “there are sufficient indications” that the investigated carried out “acts that violated the sexual freedom” of the complainant.
Thus, she relates that he allegedly convinced her to take her to the institute by car, but she deviated from the route until tourism stopped in a park in the municipality of Lousame (A Coruña). Once there, according to the tests carried out so far, he took his mobile phone, locked the car, intimidated her with a knife or razor and forced him to have sex.

According to the order, released to the press, El Chicle left the minor in the vicinity of the institute, “not without first warning her that, if she denounced him, she would kill her sister, her daughter (the victim’s niece) and then he would go for her and for her parents ”.
In addition, he told her that he had raped him as a “snitch”, referring to the fact that the minor had told her twin sister that a few months earlier, in July 2004, her husband had touched her chest over her clothes.
According to the investigating judge, the facts have, except for further qualification, the characteristics of a crime of sexual assault with vaginal penetration, with the concurrence of the aggravating circumstances of prevaluation, since the victim was his sister-in-law and was 17 years old, and having committed the aggression using a knife.
