Nonetheless, Korea’s FTC questioned whether Apple had made a genuine effort in good faith to discuss licensing fees with Samsung. What’s important is how seriously the two firms tried to resolve the patent conflict, but it’s hard to believe that Apple worked honestly with Samsung to work out their disagreements, an FTC official said through the Korea Times. So we don’t believe that Samsung used the case deliberately to hamper Apple’s business activities. Samsung challenged Apple shortly after Apple filed a patent infringement lawsuit against Samsung in 2011 over the company’s use of its 3 G mobile communications technology in various courts around the world. Apple has since won several patent infringement lawsuits against Samsung including a long-running lawsuit in California which has resulted in Apple being paid over $930 million in damages. On the other hand, last October’s administration vetoediPadsgovernment chastised Samsung by the European Commission noted that it would continue to monitor further developments in this region. Despite the findings of several other countries, Korea’s antitrust authority found that Samsung’s complaint focused on the SEP was not in violation of FRAND licensing terms. Samsung tried to resolve the matter with the standard-essential patents based on the FRAND licensing terms and the amount of the patent license fee was not so high, a Korea Times FTC official said.
