It is instead transferred to the stage of the state court so that the famous adult entertainment corporation is back to business again. Strike 3 is a subsidiary of the Vixen Media Group, a pornographic film manufacturer (Tushy Vixen Blacked) and distributor unwilling to allow their content to be illegally circulated and published. That is why pirates have been battling since 2017 trying to identify individuals via their Ip addresses. As we saw before getting the Isp to give away a subscriber’s Ip address and then equate the act of piracy with this unique identifier of internet users doesn’t always work as expected for rights-holders. Historically, federal courts have proved to be a daunting ground for Vixen Media so they take their fight to state courts. Legal experts believe that state courts have no authority to deal with this type of case but most likely the publisher wants to send the message to the community and deter piracy. Some claim that Strike 3 is simply taking this path because it’s much easier and there’s no way to rule out the possibility of getting them settlement deals. As for the specifics of the actual prosecution procedure Strike 3 is currently asking the court to allow it to force the Isps to provide the identification information of the individual pirates probably gathering hundreds if not thousands of infringers. When this is over, Strike 3 will be able to revisit the federal court case in a fresh and stronger complaint including all these pirates. The case has a particular interest and importance in seeing how U.S. courts will respond so we will inform you as changes occur.
