Re / code states that Facebook will face a class-action lawsuit accusing it of violating the privacy of users by scanning the messages it sends to other social network users. A.S. District Judge Phyllis Hamilton dismissed several state-law allegations against the company but rejected Facebook’s request to dismiss the case that will now attempt to decide how routine the scanning procedure is for the business of the tech firm. Facebook claimed that an exemption under the Federal Electronic Communications Privacy Act (ECPA) protected the suspected scanning of consumer messages for violations by service providers that occur in the ordinary course of business. Yet Hamilton argues that the social media company “did not provide sufficient explanation as to how the disputed activity falls within the ordinary course of its operations.” According to Newsweek Hamilton, Facebook had not provided sufficient information to apply for the exemption: Facebook’s message scanning specifics are vague As Ars Technica reports Facebook claims that The court replied by reading the entire terms of service of Facebook where the ambiguous language of the contract was a liability and found that the agreement did not specify that users consented to ads scanning their messages. The hearings also concentrated on whether message scanning is a normal practice in messaging operations. For example, when processing messages on a server, an email service provider is not considered to “intercept” messages. Whether the scanning device operates will have to be decided in court. Initially filed in 2013, the complaint charged that Facebook searched the content of private messages for links to websites, and then counted those links in a list of the pages ‘ “likes.” The “likes” were used in the distribution of targeted advertising to compile user profiles and the lawsuit argued that the initial scanning of private messages violated both federal and California state law. Facebook supposedly ended the practice in October 2012, but the firm claims it still performs some message “analysis” to protect users from viruses and spam. U.S. District Court Northern District of California No. 13-5996 argues that ‘ Google routinely intercepts messages from users in order to harvest user data for sharing with third parties, ‘ like ‘ advertisers marketers and other data aggregators. ‘ Law regulating our electronic communications is obsolete As the New York Times reported in 2011. The legislation can t be expected to remain in effect without changes. “ECPA’s laws depend on what type of information is being requested and how old it is, and the rules have been interpreted differently by courts in different jurisdictions. Internet companies and advocacy organizations have participated in an ongoing campaign to modernize the Electronic Communications Privacy Act, according to the American Civil Liberties Union web site. The ACLU notes that “Technology has been progressing at breakneck speed since 1986, while the electronic privacy law has remained at a standstill. The obsolete Electronic Communications Privacy Act (ECPA) allows the government to intercept and access a treasure trove of information about who you are where you are going and what you are doing that social networking sites and other websites are gathered every day by cell phone providers. “Google noted in its June Public Policy Blog that a” important digital milestone House of Representatives went on record supporting legislation that would “establish a bright-line content warrant for electronic communications law. “Upgrade seems inevitable or at least eminently necessary to a law that could provide more or less security for an email depending on how old it is whether it has been opened or where variables that Google points out are meaningless to users have been stored. Because the ECPA was enacted to broaden the wiretap prohibitions of the government to electronic data transmitted by computers, the law places Internet companies such as Google and Facebook directly between governments and users, which rose to prominence after the law was enacted in 1986. But this case places Facebook in a different position one where the company’s use of the data that users share with it could be considered in violation of the law, rather than the government’s demands for that data. Google’s own message-scanning activities are reportedly under similar legal scrutiny. Perhaps the best outcome of the litigation would be to put a new spotlight on the vagueness of the ECPA when it comes to technologies developed after 1986 and at the same time bring into public awareness the amount of data we exchange with social networks and online services and the freedoms these businesses will carry with them. All cases will have major and potentially far-reaching effects and both will be important stories to watch in the new year. Michelle Kapusta More Articles September 27, 2018 The British Royal Family has wealth fame and power but they also have their disagreements like any other family. It seems the battle is endless, from the turbulent relationships and bitter divorces to the family rivalries. Even with all the bickering and bad blood the family still attempts by putting on a united front to cover those feuds. Nonetheless, there have been plenty of blow-ups that have happened over the years within and outside the walls of Buckingham Palace.
1. Princess Diana vs. Prince Charles
Princess Diana and Prince Charles Photo by Patrick Riviere / Getty Images Disturbance between Princess Diana and Prince Charles started not long after the two married couple in 1981. When they divorced in 1992 the Princess of Wales registered her unhappiness in their union. The recordings she gave to a journalist showed the fights between the couple that the palace certainly didn’t want the public to know about including the unfaithfulness of the prince and Diana’s attempt to take her own life. 2.
Princess Diana vs. Camilla Parker Bowles
Princess Diana Torsten Blackwood / AFP / Getty Images While he was married to Diana Prince Charles, his former girlfriend Camilla Parker Bowles remained in touch and continued to see. She approached his maistress when the princess learned about it. Within Andrew Morton’s book Diana: Her True Story, the aspects of that conversation were explored. The princess recalled how unannounced she appeared at a party went right up to Bowles and told her she knew of the affair. He said Bowles denied nothing and replied by saying “‘You have everything you ever wanted. You have all the men in the world who fall in love with you and you have two beautiful kids what more do you want? ” ”
3. Queen Elizabeth II vs. Princess Diana
Queen Elizabeth II | Ben Stansall/Getty Images It was in this meeting that the Princess of Wales delivered an unforgettable linethree of us were in this marriage, so it was a little crowded”when thinking about the prince cheating on her. Diana often opened up about how much she was romantic with Charles and about her own affair with James Hewitt, a riding instructor. Unhappy with all that was discovered by her daughter-in-law, the queen sent a letter asking that the princess divorce her sonlost the exclusive rights to Christmas broadcast from the queen. 4.
Prince Andrew vs Prince Charles
Charles and Andrew weren’t the family’s only brothers who didn’t have good relations. George VI and Edward VIII allegedly retained a deep-rooted hate for each other that stemmed from Edward’s constant abuse of speech impediment to his brother. The dispute continued for years even after Edward abdicated the throne in 1936 to marry his lover Wallis Simpson, an American divorcee. George did not trust his brother, and he and Simpson reportedly had agents tailing him as they traveled after rumors surfaced accusing the pair of being Nazi sympathizers and welcoming to Adolf Hitler. 6.
For a number of reasons, the involvement of Elizabeth the Queen Mother vs. Wallis Simpson
Simpson with Edward VIII caused major confusion in the royal family, and it was alleged that the Queen Mother and the Duchess of Windsor had a deep longstanding feud. The sisters-in-law partnership even became the subject of BBC documentary titled disturbed by the fact that he and Simpson got married. The palace said the two women never had a feud, but their hate arguments for each other never died down. 7.
Prince Philip vs. Fergie
While Prince Andrew and Sarah Ferguson divorced in 1996, they have always remained close and focused on raising their daughters Princess Beatrice and Eugenie. But Prince Philip is one family member who can’t seem to hide his difficult feelings for the Duchess of York. Andrew’s father apparently never forgave Fergie for the harm she did with her extramarital affairs to his family’s reputation and the inability to keep her name out of the tabloids. Phillip’s loathe for the ex-wife of the Duke of York was evident when Andrew in 2015 welcomed her to the Royal Ascot. The queen bowed to her son and to Ferguson upon their arrival. But Philip did not look happy when he saw Fergie and did a double take (which photographers captured) to let everyone know he might believe she was there. 8.
Queen Elizabeth vs. Prince Charles
After the death of Diana there was a reported split between Prince Charles and his mum. The Daily Mail reported that after receiving news that Diana had passed away, a biography about Camilla Parker Bowles addressed the role she had in consoling Charles. The book alleges that after hearing that his ex-wife died in a hospital in Paris, the queen did not console her son, nor did either of them “discuss logistics.” Maybe it was surprise or uncertainty, as it was a difficult time when the family had to deal with an unspeakable tragedy and think about what the public perception of them was going to be. 9.
Charles Spencer vs. the royal family
The gauntlet was thrown down and the lines of battle between the Spencers and the Windsors were drawn when Charles Spencer, the brother of the late Princess of Wales, delivered the eulogy at her grave. Spencer issued a five-minute tirade on the press for harassing his sister, and went personally with some unkind words after the royal family. This was said to have upset the queen because she felt that Spencer had not honoured Diana’s memory the way she thought he was supposed to have and this created problems for years between the two families. 10.
Bowles
Queen Elizabeth vs. Camilla ParkerCamilla Parker Bowles and Kate Middleton Chris Jackson / Getty Images In 2016 Christopher Andersen’s book sparked rumors that his stepmother Prince William was trying to break up with Kate Middleton. In Game of Crowns, Andersen reported that in 2007,
the Duchess of Cornwall asked Prince Charles to persuade William to break things off with Middleton and he did. The explanation is said to be that Bowles worked hard to win over the British public and was “disgusted” because, instead of her, everyone seemed to fall in love with Middleton. When William and Middleton got back together weeks later, Bowles was allegedly ticked off by how the general public once again accepted the commoner.
The royal family’s share of drama has exceeded. Chris Jackson / Getty Images The Duke and Duchess of Cambridge toured Canada and Los Angeles as married couple together in 2011. With their first official outing, the famous royals hoped to impress everyone but allegedly struck out with Prince Charles. According to the biography on Charles by Sally Bedell Smith the prince thought his son and daughter-in-law were in far too many “tasteless” pictures while on their trip to North America. It has also been claimed that Charles was jealous of the success of William and Kate given the large crowds that welcomed them during their journey much larger than the small number of people who greeted him and Bowles when they traveled abroad.
James Middleton Stuart C. Wilson / Getty Images In 2015 Kate Middleton’s brother James allegedly drew the ire of Queen Elizabeth when he conducted an interview and said that the Duchess of Cambridge’s sibling was ‘ frustrating. ‘ “Yes James knows it gets frustrating. I’m working incredibly hard “just like any other person in business and work and apart from the fact that I’m the brother of someone very influential I’m just James at the end of the day.” Obviously the queen wasn’t excited because she never liked family members or those close to the family doing interviews about them. A source said the queen was furious with James for doing so, and asked Kate not to speak more about the royals to let him know. 14.14. Prince Charles vs. Princess Eugenie and Beatrice
Princess Eugenie and Beatrice and Prince Charles Chris Jackson / Getty Images Prince Charles ‘ rivalry with Prince Andrew got even more intense in 2016 when the former announced his plans for the future and “slimmed down the monarchy.” Andrew was so concerned about how this change would affect his daughters that he wrote a letter to them. Given the ongoing rivalry of the brothers, it seems unlikely that his nieces will have a formal role within the royal family once Charles takes the throne. 15.15. Royals vs. press
The press could be the greatest problem for the royal family. Chris Jackson / Getty Images One of the royals ‘ most complex ties is with the public. The family have consistently argued that their privacy is far too much violated. Photographers caught some rather embarrassing pictures of Fergie doing topless sunbathing and having her toes sucked by another guy while still married to Andrew. Two years later, while on holiday in France, Prince Charles was shot in the buff and years later, paparazzi snapped a picture of Cambridge’s Duchess sunbathing without a top on. But Princess Diana’s relentless follow-up and hounding is where the deepest wounds lie as she was chased around by the press until her death in 1997. More Articles February 25 2013 Here’s your Cheat Sheet to the week’s most critical housing econ releases and how the biggest stocks responded … Existing home sales The housing market continues to benefit from low mortgage rates and inventory levels as existing-home sales edged slightly higher last month. Such inventories hit our income expectations. To discover winning stocks click here now! For existing-home sales, analysts and economists surveyed by Reuters and Bloomberg both predicted a rate of 4.9 million units. The December rate was downwardly revised to 4.9 million units. In the so-called housing recovery tale tight inventory is still a major factor. Lawrence Yun NAR chief economist states that buyer traffic keeps on picking up while seller traffic keeps steady. In reality, buyer traffic is 40 per cent higher than a year ago, so there is plenty of demand but inadequate inventory to boost sales. We’ve been turning into a seller’s market in much of the country.” At the end of January, overall housing stock dropped nearly 5 percent to 1.74 million existing homes available for sale. This is a 4.2-month supply down from 4.5 months in December at the current sales pace and the lowest housing supply since April 2005. Similar to the inventory mentioned last year, there was a 6.2-month supply of 25.3 per cent lower. Raw unsold inventories have been at their lowest level since December 1999. Nevertheless home prices still receive support. The national median exit-home price for all types of housing last month was $173,600, a 12.3 per cent leap from a year ago and the best month since November 2005. Home prices have now risen year-over-yearly for 11 consecutive months. Are you doing enough to plan for retirement? Housing Starts The Commerce Department s Wednesday study on U.S. homebuilding gave an impression of an improving but still incomplete recovery as much of the economic data released in recent months. Housing starts for the month of January dropped by 8.5 per cent to a seasonally adjusted rate of 890,000. Comparing this statistic with both the previous month’s and last January’s figures indicates that residential rehabilitation still faces some barriers. Homebuilders started construction on 973,000 new homes in December, while new-home construction rose 23.6 percent in January 2012. Economists were not overly optimistic ahead of the study but had expected much better results. According to a survey conducted by Dow Jones Newswires, a fall in housing starts was set at 3.1 per cent as their consensus estimate. There have been signs of growth however. Building single-family homes a homebuilding segment that accounted for nearly two-thirds of all new housing starts last month increased 0.8 percent to a rate of 613,000 units a 20 percent gain from a year earlier. Moreover, the building of single-family homes had been at its highest level since the start of the financial crisis. The statistics for single-family home construction offered a indication that the housing market is growing, just as the number of new building permits increased. The number of new permits a potential building sign jumped 1.8 per cent last month to an annualized average of 925000. This is the highest amount reached since June 2008 and it surpassed analysts’ estimates for a peak of 920,000… The housing sector has been pegged by economists as a bright spot in the U.S. economy and an significant growth driver. According to The Wall Street Journal, last month the Department of Commerce reported that spending on home construction and home improvements led to economic growth in each of the past seven consecutive quarters. But housing beginnings remain below historical levels; only 780,000 homes began construction last year. The U.S. is on track for modestly higher annual performance this year. Some parts of the country registered highly divergent results; housing starts fell 35.3 percent in the northeast and 50 percent in the midwest, while the west saw a 16.7 percent increase and the south saw a 4.1 percent increase. Results from luxury home builders announced on Wednesday. Homebuilder Trust Deteriorated unexpectedly in February after hitting multi-year highs of trust among U.S. homebuilders. The surprise among housing-related stocks is causing a swift reality check. The morale booster of the National Association of Home Builders / Wells Fargo for newly built single-family homes dropped to 46 this month compared to the 47th reading of January, which has been the best level since April 2006.
